Q: Can a merchant pursue a customer after losing a dispute case with American Express?

I rented a vehicle from SIXT at Lisbon Portugal Airport in August 2023.

Regrettably, the rental car provided by SIXT had pre-existing windshield damage.

• Due to the low light in the garage crack was not visible.

• On September 15, 2023, SIXT charged my credit card €772.02 for the windshield damage, which was not caused during my rental period.

• Despite my efforts to resolve this issue with customer service, they refused to comment.

• Therefore, I disputed the €772.02 charge with my credit card carrier. After an investigation, AMEX bank informed me that SIXT Portugal RAC_307_MOTO company had agreed to issue a credit.

• On January 23, 2024, the SIXT accounting department contacted me to collect the exact amount they already collected before

Question: Can a merchant use a collection agency to pursue a customer after losing a dispute case with American Express? And what are my options?

A: Considering the complexity of the situation and the potential legal implications, it may be advisable to consult with an attorney. An attorney can provide guidance on your rights and options, review any relevant documentation, and advise you on the best course of action moving forward. They can also assist you in navigating any further disputes or legal proceedings with SIXT, ensuring that your interests are protected and advocating on your behalf. Consulting with an attorney can help you make informed decisions and address the issue effectively.
