A: In California, as a beneficiary of a will, you have rights to be informed about the estate and the distribution of assets. If your sister is the executor and is not being transparent or fair, you can request a copy of the will and an accounting of the estate from her. Executors have a legal duty to act in the best interests of the beneficiaries and to manage the estate according to the will's terms and state law.

If you believe that the executor is not fulfilling her duties or is acting unfairly, you can petition the probate court for intervention. This includes requesting the court to compel the executor to provide an accounting, to distribute the assets as directed by the will, or, if necessary, to replace the executor.

Given your concerns about affordability, you might explore legal aid organizations or pro bono legal services in California that can assist individuals in probate matters. Additionally, some attorneys offer free initial consultations which could provide you with guidance on how to proceed. It's important to protect your rights and ensure the will is executed fairly and according to law.
