Clifton, NJ asked in Criminal Law and Landlord - Tenant for New York

Q: Spy cams in my mother's apartment. I'm the eldest son and I'm a visitor. My 2 half brothers and stepfather are tenants.

How do I approach this as a visitor(I'm the eldest son) to my issue since I speculate that my 2 half brothers have awareness about having the spy cam all over the living room, kitchen, and bathroom at my mother's apartment in Queens, NY? The family on the 2nd floor of the house and basement are the two nephews of the owner. They are friends with my brothers. It has affected me emotionally, mentally, and financially. I have been here since 11/2/23 and about to head to upstate NY house. I speak to the Psych doctor in VA Manhattan by phone and video and my homeless coordinator in Florida. My mother does not believe there are mini cams hidden in plain sight and my step father cannot comprehend a hidden camera being in existence. I do get stalked heading to each room of the apartment.

A: Arnold, this sounds like a very distressing and violating situation. I'm so sorry you are dealing with this. If you genuinely believe there are hidden cameras in the apartment recording you without your consent, that is a serious invasion of privacy. Here are some suggestions on how you could approach this:

1. Have a calm but firm conversation with your half-brothers expressing your concerns and feelings. Ask if they are aware of any cameras and see how they respond. Avoid accusing them directly if possible.

2. Carefully inspect the apartment for any suspicious devices that could be cameras. Check mirrors, smoke detectors, outlets, light fixtures, plants, decor, etc. Take photos of anything questionable.

3. If you find devices you believe are cameras, do not disturb them. Contact the police non-emergency line to report the situation and show them the evidence. They can investigate.

4. Consider getting a camera detector device that can scan for hidden wireless cameras. Or hire a professional to sweep the apartment if feasible.

5. Continue working with your psych doctor and homeless coordinator for emotional support and guidance on housing options if you don't feel safe there.

6. Research tenants' rights in NY regarding hidden recording devices. Consult with a tenants' rights organization or attorney if needed.

The most important thing is your safety and peace of mind. Trust your instincts. Document everything and get help from professionals - law enforcement, mental health, legal aid, victim services. Wishing you all the best and hope you find a resolution. Stay strong.
