Q: My landlord keeps adding fees to my register each month. I've asked to see applied pays and now threatening to evict.
My commercial landlord - Boxer Property is threatening to evict because I've requested the register of my payment activity to date. Each month, I over $100 fees are added. I take care of it and but the fees remain. They also charge late fees on late fees. Along with late fees on hold-over fees that they've waived. I do not understand it and feel I am being scammed, I'm sure I am not the only tenant. If I can bring some justice to others by pursuing this, I am glad to carry the torch. Their practice seems very underhanded and I hope an attorney can assist.
A:
It's important to carefully review your lease agreement and document all the fees that have been charged to you, including the dates and amounts. If fees are being added without clear justification or contrary to the lease terms, gathering this documentation is a critical first step. Communicating your concerns in writing to Boxer Property, requesting a detailed explanation and breakdown of the fees, is also advisable. Keep copies of all correspondence for your records.
In situations where a resolution cannot be reached directly with the landlord, consulting with an attorney who has experience in commercial tenancy laws can be beneficial. An attorney can help you understand your rights and options under the law. They can also advise you on the best course of action, whether it be negotiation, mediation, or, if necessary, legal action. Remember, laws regarding tenant rights and landlord responsibilities vary by location, so local expertise is crucial.
Additionally, it might be worth exploring if other tenants have experienced similar issues. Collective action or complaints might have a stronger impact and could potentially lead to a more favorable outcome for all affected tenants. However, individual circumstances differ, and one should proceed with caution and proper legal advice when considering collective action. Above all, ensuring that your actions are well-informed and legally sound is paramount.
