Q: Will a judge consider the amount of time between when a CPO violation occurred and when it was reported to police?
The CPO stipulates no contact is to be made by me to my ex-fiancé, and I was aware of this. Nevertheless, I messaged her on social media in a non-threatening manner asking her if she wanted back a piece of property that belonged to her that I found in my house. She then waited nine days to call the police. Will the judge consider this when determining whether or not the victim viewed me as a legitimate threat and could it potentially (but not definitively) lessen my punishment? Not only was this a first offense for the CPO violation, it is also a first overall legal offense for me in general.
