Asked in Car Accidents

Q: I was in a accident where the other driver crossed the road I was driving on.

Instead of clearing my lane of travel , he stopped. I could not stop in time and hit him at his rear passenger door. My insurance company seems to be trying to fault me. Sadly we have the same insurance company. What can I do?

A: I'm sorry about your accident. I hope you and others involved are okay. Your question doesn't include a state or territory, but as a general matter nationwide, these settings could depend on additional details, such as traffic control devices, signage, road markings, where other vehicle crossed your path from, etc. Ask your insurance company the basis for their determination that you're at fault - it's possible they already have a police report, or sent an accident investigator to the site to examine things more closely. Good luck

A: Addendum - If the accident resulted in a lawsuit against you from the other side, immediately provide your carrier with the papers - they should arrange for your defense. Good luck
