Q: Can you take someone to small claims court for insurance deductible that you had to pay due to them not having ins ?
In jan a lady hit my parked car with her horse trailer. We tried to get in touch with her insurance for weeks and they keep saying it is waiting for processing in otheir system. Talked with out insurance and was told we needed to file it under outs with uninsured motorist. We are out 500 for our deductible and 500 for the rental car. Can we take her to court to cover the cost that occured due her neglect. Our insurance company said they are will file with her company so they will get their money back but would about the money that I am out ?
