Q: Despiden injustificadamente tras volver de incapacidad por accidente de trabajo, que toca de liquidacion de ley?
Un empleador despide al trabajador 2 semanas despues de reintegrarse a actividades, afirmando que el trabajador se accidento porque ignoro medidas de seguridad. El accidente sucede mientras trabajador sigue el proceso de seguridad que esta definido para el proceso que realizaba, y previo a ello el trabajador notifica a supervisores que lo enviaban a una actividad con personal no capacitado como apoyo y en lugar de asignar a alguien capacitado lo fuerzan a realizar la actividad en esas condiciones. Y resulto que se accidento. Al parecer ahora los discriminan por su accidente de trabajo, porque no podia hacer algunas de sus actividades mientras me recuperaba completamente.
Investigue que toca por ley y dice que son:
- 3 meses de salario
- 12 dias por año laborado
- Prima de antiguedad
- 20 dias por año laborado ?
No se si me faltara algo en ese calculo? o que me sobre algo?
