Q: How can I modify an ex parte civil protection order against me ahead of hearing to allow phone calls to my daughters?
I didn't receive service before the hearing which is within 10 days of the filing/granting of the order. The reasonable amount of time the hearing was rescheduled for was two months out during which time I'm not allowed to even communicate with my daughters. I don't necessarily want to expedite the hearing as I'm struggling to find representation and the last guy wanted $500 just for consultation no thanks. I just want to be able to talk to my daughters. My ex wife lied about quite a few details and lived at a different address than my daughters who stay with her mother during the night time. During our divorce she was granted an ex parte protection order based on complete lies and due to the judge "not being in the court" at the time of hearing she rescheduled it 4 months out, past her stay, and literally last minute her lawyers were able to dismiss it to the point it was still on the docket but "dismissed" the day of.
A: Unlikely. The soonest the court could even hear that motion would likely be your existing hearing date.
