Q: How can I stop relocation charges from HPD when I fixed my violations? I am being charged for tenants living at shelter.
Hello, I need some assistants as landlord who have been facing relocation charges from HPD for almost about a year now. I need help as a way out of this. HPD has been uncooperative and unwilling to help. I got a violation last year in February from DOB, a vacate order. Which has been fixed and cleared by them. HPD said that tenants that lived in that basement had to leave because of the vacate order and that is why we have to pay. However, the tenants left on their own in March. I started getting these charges August of last year. I fixed my violation and go everything professionally fixed. The charges I am facing is causing me finical issues. I tried contacting HPD on ways to stop these charges or at least get them reduced but was unable get any solution. I provided HPD with more than 15 available apartments for the tenant so they can move out but they have not gotten back to me. I talked to DOB and they as well does not have an answer for me as of why I am facing these charges.
A:
Dear Brooklyn Property Owner:
Several possible city departments are entitled to demand payment of expenses and fines when an agency issues a vacate order and a tenant is displaced from an illegal dwelling.

Your tenants may have left on their own rather than be evicted, but if the relocation even to a shelter is due to a vacate order, there is generally an obligation to pay imposed on the landlord. See: https://www.nyc.gov/site/hpd/services-and-information/hpd-charges-and-fees.page
