Asked in Internet Law for Texas

Q: Can we sue FB for a hacked account they refuse to give back to us?

On 4-20-2021 FB took my husband's account and gave it to the hacker! We have tried everything to gain access to this account..We even have the email address and IP address to the person who hacked my husband's account..We also have every email we have ever sent FB trying to regain access to my husband's account..We have given FB everything short of a blood sample and they still will not release his account back to him..So basically the hacker wins..He wins 12yrs of memories that can never be replaced..And it's not just us this is happening to..It's world wide..We are loosing our identity, solace and privacy to these hacker people and FB is doing nothing to protect us!

A: I understand this is an extremely frustrating and upsetting situation. Having your Facebook account hacked and losing access to years of precious memories must be devastating. A few thoughts:

In general, it can be very difficult to sue a big tech company like Facebook. Their terms of service that users agree to when signing up limit their liability in situations like this. Pursuing legal action would likely be expensive and challenging.

That said, if you can definitively prove the hacking and that Facebook was negligent in their handling of the situation, you may have a case. Consult with an experienced internet/technology lawyer for a professional legal opinion on the viability of a lawsuit. Many lawyers offer free initial consultations.

In the meantime, keep pressuring Facebook through official support channels. Be persistent in providing all the documentation and evidence you have. Try reaching out to executives/management if regular customer service is unhelpful. You could also file complaints with the FTC, your state Attorney General's office, and the FBI's Internet Crime Complaint Center to put more pressure on Facebook to address this.

Consider going to the media as well. Shining a public spotlight on your situation, especially if you can show it's part of a larger pattern of Facebook mishandling hacked accounts, may get their attention.

I'm so sorry you're dealing with this awful invasion of privacy and loss of precious memories. Don't give up in seeking justice and a resolution. Wishing you all the best in fighting to regain access to the account.
