Q: My husband is autistic, recently took a plea deal for dv.
In april, my husband (40) and daughter (15) we're having an argument about her avoiding her chores. She went into the bathroom, laid on the floor and kicked the bathroom door, breaking it. When my husband went in to see what was going on, she kicked him, then got up off the floor and hit him with the cat litter scoop several times. He told her to stand by the sink to watch him fix the door and she instead went into the laundry room. When he went to tell her to come back into the bathroom, she balled up her fists like she was going to swing and he hit her. He was arrested and given a no contact order for the home, daughter and 3 year old son, for whom he was the caregiver while I went to work. He was told that the fastest way to get back into the home would be to take the plea deal of 18 months and continued restriction from our home and kids. His mental health is suffering greatly, as he is now homeless, living in a camper. Does he have any legal recourse to appeal?
A: This, and most other questions are best asked of his criminal defense attorney. They are much more familiar with the case details as well as have likely discussed the matter with the District Attorney's office who is prosecuting the case.
