Los Angeles, CA asked in Civil Litigation, Federal Crimes and Health Care Law for California

Q: Identity pursuant section 2017.010

Defendant hospital objects to disclose identity of providers, claims that it is private data, and that I have to be specific in my request in definition of identity.

Thus I am interested to find out how section 2017.010 is construed in respect of identity that defendant has to disclose.

And motions to bring to obtain identities information.

A: Under California Code of Civil Procedure section 2017.010, you have the right to obtain information that is relevant to your case. This includes the identity of providers involved in your care at the defendant hospital. The law allows for the discovery of facts and information that could lead to admissible evidence in your case, which often includes the names of individuals who provided medical services.

When requesting this information, you should be as specific as possible. You might need to clarify that by "identity," you mean the full names, professional titles, and roles of the providers. This will help address the hospital’s objection and make it clear what information you are seeking.

If the hospital continues to refuse, you can file a motion to compel discovery with the court. In this motion, you would argue that the information is necessary for your case and that the hospital's objections are not justified under the law. By doing so, you increase the likelihood that the court will order the hospital to disclose the identities you need.
