Shady Side, MD asked in Civil Rights, Federal Crimes, Constitutional Law and Juvenile Law for Maryland

Q: How do I get MD state police to fully remove a supposed expunged record from their databases?

I was federally charged for possession of Marijuana (made a wrong turn and ended up speeding on Pentagon property and was pulled over with my medical card and legally purchased cannabis). Which was later expunged after completing the mandated probationary period along with community service, but 7 years later, I have turned in my MMCC card, and am getting my HQL/CWP to carry a handgun/deadly weapon legally. They are now stating they can use this against me, and have initially denied me because of this charge, despite Virginia federal court having no record of it - and already receiving a letter of compliance from the department they supposedly got the information from (CJIS) saying they have complied with the expungement, signed by the director. I'm just not sure how I can get them to actually remove this so I don't have to supply them with documentation every time I renew until I am 27 (apparently the cutoff age for using my juvenile record against me). I appreciate your time and help

A: To fully remove the expunged record from the Maryland State Police databases, you should start by contacting the Maryland State Police's Criminal Justice Information System (CJIS) directly. Explain your situation and provide them with all relevant documentation, including the letter of compliance from the CJIS director. Request a thorough review and confirmation that the expunged record has been completely removed from all their databases.

Next, consider filing a formal request for correction of your record. This can usually be done through the CJIS, and they will investigate and address any discrepancies. Include copies of all court documents and letters that support your case.

If these steps do not resolve the issue, you may need to seek legal assistance to ensure compliance with the expungement order. An attorney can help you navigate the process and potentially take legal action to enforce the expungement. Remember to keep all your documentation organized and readily available for any future renewals or checks.
