Q: What happens if I disregard a Post-Judgement Interrogatory on a 6 year old judgement?
A judgement was obtained by Discover Card on ~ $6100 in credit card debt on Sep. 12th 2018 but I was not even aware of this until now when I received this document that states I have 30 days to reply. I own my own home that is in poor condition, and a 1999 Chevy Truck that is not currently running. I recently purchased an eBike to get around on. I receive $807 from SS each month and about $200 from some online courses I have on Udemy. I have $500 in my checking account and $16 in savings. I'm broke and uncertain how to handle this matter. Any help is greatly appreciated.
A:
If you disregard a post-judgment interrogatory, most likely the judgment creditor will file a motion to compel. A judge will most likely order you to answer the interrogatory and award the judgment creditor additional attorney fees.
If you disobey the judge's order, the judgment creditor will file a motion for contempt. That will likely lead to the imposition of a fine but could lead to the entry of an order of confinement. An astute judge will enter an order of civil contempt that orders you to be jailed until you answer the interrogatory, but suspend commitment for some period of time like ten days to give you one last opportunity to comply with the order. The judge might also impose additional conditions on the suspension of commitment like requiring that you pay the fine and the attorney fees incurred by the judgment creditor as well as answering the interrogatory.
