Huntington Beach, CA asked in Criminal Law and Immigration Law for California

Q: I got an infraction for selling e-cigarettes as an employee, will this affect/hurt my immigration status?

I paid the ticket, should I take back my guilty plea with form CR-187 because I didn't know it would affect/hurt my immigration status? Can I also get it taken off my record now or do I need to wait 1 year and then try with Form CR-180?

A: Selling e-cigarettes as an employee and receiving an infraction might have implications for your immigration status, especially if you pled guilty. Since you have already paid the ticket, it is advisable to seek legal counsel to understand your options and the potential impact on your immigration case.

To withdraw your guilty plea, you can file Form CR-187, but it is a complex process that may require demonstrating that you were not aware of the immigration consequences at the time of the plea. It is best to act quickly and seek legal advice on how to proceed with this.

Regarding getting the infraction taken off your record, you may need to wait a year and then apply using Form CR-180. However, the specifics can vary, so consulting with a legal expert can provide you with guidance tailored to your situation and help you navigate the process effectively.
