A: In California, if you have a court order granting you custody of your child and the father is not complying, you do have legal options. It’s important to document everything and keep a copy of your court order on hand. Law enforcement should enforce court orders, but there are situations where they may not intervene directly, such as when they believe it to be a civil matter.

You can file for an emergency hearing in family court to address the violation of the custody order. The court can issue additional orders to ensure compliance, and in some cases, it might hold the non-compliant parent in contempt of court. This could result in fines or even jail time for the non-compliant parent.

Additionally, you might want to seek the assistance of a family law attorney who can help you navigate this process and ensure that your rights, as well as your child's well-being, are protected. Remember, it's crucial to act swiftly to enforce your custody order and ensure your child's return.
