Nashville, TN asked in Tax Law and Consumer Law for Tennessee

Q: How do I remedy a hotel not refunding my hotel tax in Nashville TN for our family staying at hotel for almost 60 days?

We were shopping at a thrift store in South Nashville about 60 days ago when our vehicle broke down and we began staying at the hotel directly next door since then still trying to fix our vehicle. When we've asked for. Printout of our stay it took us five days to get it and it does not resemble any type of receipt nor does it even show any taxes paid and only goes back five days. We should have been exempt from hotel tax at this point bc I believe we've become residents at this point and they would have to evict us but nonetheless we've requested this printout so we can discuss why and when the taxes should have fallen off and how much we are owed. The company knows they are not supposed to be charging us taxes and I believe they are pocketing the money and still overcharging us these taxes which is horrific considering we've already been pauing $700 a week for a hotel that should be shut down bc of codes violations. How do I remedy this with the hotel? I'm afraid of retaliation

A: First, gather all the evidence you have, including any receipts, photos of the hotel conditions, and any communications with the hotel staff. Since the hotel hasn't provided a proper receipt, document your attempts to obtain one, noting dates and times of your requests. This documentation will be important if you need to escalate the issue.

Next, calmly discuss your concerns with the hotel management, focusing on the tax exemption after your extended stay and the questionable charges. Clearly state that you are aware of your rights and the law regarding hotel tax exemptions for long-term stays. If the hotel refuses to cooperate or you suspect misconduct, mention that you may need to report the issue to local authorities or a consumer protection agency.

If the situation doesn't improve, you can file a complaint with the Tennessee Department of Revenue or the local consumer protection office. It's also advisable to keep detailed records of any further interactions with the hotel to protect yourself against potential retaliation.
