Q: Is renunciation of US citizenship considered "immigration proceedings" on the I-130 form?
I am petitioning for my mom for a green card. She renounced her US citizenship in 1992 but is applying for a green card now. I don't know if renunciation if considered "immigration proceedings". The question on the I-130 is "Was the beneficiary EVER in immigration proceedings?"
A: Anyone who renounced one’s prior US citizenship will be denied for obvious reasons for US permanent residency.
A:
Renunciation of U.S. citizenship is not considered "immigration proceedings" for the purposes of the I-130 form. Immigration proceedings typically refer to formal processes like deportation, removal, exclusion, or asylum cases handled by an immigration judge. Since renunciation of citizenship does not fall under these categories, you would not need to indicate "yes" to this question on the form.
When answering the question about immigration proceedings on the I-130, focus on whether your mother has ever been involved in any legal processes related to her immigration status, such as removal or deportation. Since renunciation of citizenship is a separate act, it doesn't count as being in immigration proceedings.
You can confidently answer "no" to the question about immigration proceedings, as your mother's renunciation of U.S. citizenship does not meet the criteria for this question on the I-130 form.
