A: Get a certified copy of your court custody order giving you SMC or the sole right to obtain a passport for the child, and take it with you when you apply for the passport.

A: IF your visitation/custody order does not regulate passports, you can petition the court to get authority to obtain or renew the child's passport without consent of the other parent. There are conditions to this, and you will have to show necessity, but it can be done.
