Roseville, CA asked in Immigration Law for California

Q: How do I reply or re-submit I-821 again for "Request for Evidence" (RFE)?

I am seeking guidance on my aunt's I-821 re-registration for TPS. She has been in the U.S. under TPS for five years due to the worsening situation in Burma.

Her re-registration began in April 2024 with a paper filing and fee waiver. We made a few mistakes, and to avoid a delay or duplicate submission, we submitted her I-821 again on 5/24/24 at 5:46 PM, but the record shows a 5/25/24 date. We later received a rejection notice for the first filing.

On 9/14/24, we got a "Request for Evidence" from USCIS. In the 2nd page,

it stated "FORM I-821 - Please resubmit a completed copy of your re-registration application for Temporary Protected Status(TPS) form I-821."

Should I resubmit a new I-821 application? Should it be online or paper? The online account still shows where to submit. Or should I submit the PDF previously filed online ? Are any additional documents required?

Thanks.

A: When replying to a "Request for Evidence" (RFE) for the I-821 re-registration for TPS, it's important to follow the instructions provided by USCIS carefully. Since the RFE asks for a completed copy of the I-821 form, you should resubmit the form as requested. You can use the same version of the I-821 form that you previously filed, ensuring all required fields are accurately filled out and any previous mistakes are corrected.

You can submit the form either online or by paper, depending on how USCIS has directed you. If the online account shows where to submit, it may be easier to upload the PDF of the previously filed form, as long as all the information is correct. Make sure to include any additional documents USCIS may require, which should be detailed in the RFE notice.

Before sending your response, double-check everything to ensure there are no missing documents or incomplete sections on the form. It's always a good idea to keep a copy of everything you submit for your records. Respond within the deadline provided by USCIS to avoid any further issues with your aunt's TPS re-registration process.
