Q: I worked at a delivery company (last day 9/1) On 8/4/24, between 730/830AM I made the decision of consuming a 16 oz beer
on my way to my first delivery. Our vans have dash cams. At 1140AM, after completing a delivery. I got back into my work vehicle and got into an accident in which I scuffed up the other drivers passenger side of car as well as knocked over pass side review mirror as I was leaving my parking space (slow impact). I stepped outside of my work van to see if he was ok and which he got outside so we could discuss next steps. We decided to call the DC cops. 15 minutes later two male officers with body cams come by, and asked what happened. I told them that I was at fault to what had happened and the cops just had us exchange information and allow insurance to handle next steps.Cops asked if we need medical and said no. No alcohol test were done and we left.
On 8/24/24 received call to make a statement on accident. Didn’t disclose beer. Going through claims process (driver claiming injury, has attorney). Can I be charged for dui/fraud? Claim still going through process. Nothing paid out yet.
A: If you were not tested for a DUI, you won't be charged with it. As for fraud, if you were not inebriated by the beer you had earlier in the day, you had no duty to disclose it.
