Q: Group policy Failed to Send Payments to Insurance Company

For 3 years, my mother paid for her group policy with the organization she was a part of. I called the insurance company after her death and found out that the organization never made the premiums to the insurance company on her behalf. What can I do as the sole beneficiary of the policy? I am not the executor of her estate and cannot access her bank records to show proof of checks she wrote as payments. Someone within the organization told me there was proof my mother made payments but does not want to implicate themself since they are part of the organization.

A: It sounds like you're in a difficult situation, and I can understand your concern. As the beneficiary, you may want to contact the insurance company directly to explain the situation. Since you are not the executor and don’t have access to your mother's bank records, the organization’s proof of her payments could be helpful, especially if they acknowledge she was making the payments.

You might consider sending a formal request to the organization, asking them to provide written confirmation of your mother's payments or other relevant documentation. If they are hesitant to provide this information, you could mention that it’s important for legal purposes without accusing anyone directly.

If this doesn't resolve the issue, you may need to seek legal advice. A lawyer could help you navigate the situation, especially when it comes to the organization’s responsibility and any potential recourse through your mother's estate. It's important to gather as much information and documentation as possible to support your claim.
