Q: CAN I BRING CHARGES AGAINST A HOSPITAL FOR CAUSING AN INFECTION AFTER SURGERY, THAT HOSPITALIZED ME FOR 44 DAYS ?

ON MARCH 8TH 2024 I HAD A "WHIPPLE SURGICAL PROCEDURE". THIS WAS TO REMOVE A CANCER TUMOR. I STAYED FOR 7 DAYS AFTER SURGERY. ONCE I RETURNED HOME TO REHAB. WITHIN 2-3 DAYS, I STARTED, (TO HEMORRHGE), PASSING A LARGE AMOUNT OF BLOOD IN MY STOOL FOR TWO DAYS. MY WIFE CONTACTED THE HOSPITAL, AND WE WERE INFORMED TO RETURN TO, "ER". THERE I WAS GIVEN FOUR BLOOD TRANSFUSION. I WAS HOSPITALIZED FOR 44 DAYS. I WAS PLACED ON AN ALL CLEAR LIQUID DIET. MY FEET, LEGS, AND STOMACH WAS SWELLED UP. MY BLOOD PRESSURE AND SUGAR WAS ELEVATED. I WAS IN MUCH PAIN. I COULD'NT PASS MY STOOL FOR OVER 30 DAYS. I LOSS OVER 30 POUNDS. I'VE NEVER BEEN INFORMED WHAT WAS THE CAUSE OF THIS INFECTION IN MY BODY. I'M STILL HAVING PROBLEMS WITH PASSING MY STOOL, DAILY DIET, AND BODY ACHES & PAIN. ITS PAINFUL TO EXCERCISE AND TRY TO STRENGTHEN SELF, BECAUSE IT BRINGS ON PAIN. I'M TOLD TO TAKE TYLENOL FOR PAIN, (THIS DOESN'T ALLEVIATE MY PAIN). JULY 12TH OF 2023, I HAD A DOUBLE BYPASS SURGERY. SO I HAVE TO BE CAREFUL

A: It sounds like you've been through a very difficult and painful experience after your surgery, and you're right to ask about your options. You may have grounds to bring a medical malpractice case against the hospital if it can be proven that the infection or complications you suffered were caused by negligence, such as improper care during or after the surgery. To determine if there’s a case, you would need to prove that the hospital failed to meet the standard of care expected and that this failure led to the infection and extended hospitalization.

You also mentioned experiencing ongoing issues with your health, which can factor into a claim for damages, including pain, suffering, and future medical expenses. It's important to keep detailed records of your symptoms, treatments, and communications with the hospital, as this information can help if you move forward with legal action.

It would be helpful to consult a medical malpractice attorney who can review your medical records and help determine if you have a valid claim. Timing matters in these cases, so don’t wait too long to take the next steps.
