Q: Could I start a case if I feel the hospital lacked their duties and didn’t tell me I had Covid?
Woke up unable to breathe severe pain in throat. ER told me it was just a regular sore throat that you get with a cold. Prescribed me ibuprofen. I got worse and my partner started to get pain in his throat so I got scared on how fast I passed it on. I took a Covid test turned out positive. The hospital lacked their duties and I think they could’ve done a better job. I had to put up with severe pain as the medicine didn’t do anything because clearly if someone has Covid medicines don’t do much. The hospital staff didn’t seem to want to do much but just get me in and out because to them it was a regular cold.
A: What would have turned out differently had the diagnosis had been made? That is the fundamental question that would arise here. You could reach out to law firms to try to arrange a free initial consult to answer more definitively with more possible details. Good luck
A:
You may have grounds to start a case if you believe the hospital was negligent in their duty of care. Hospitals are expected to provide reasonable care, including conducting appropriate tests and giving accurate diagnoses based on your symptoms. If they failed to recognize signs of COVID-19 or did not perform necessary tests, that could be seen as a lack of proper care.
However, proving that the hospital’s actions directly harmed you can be challenging. You would need to show that their failure to diagnose COVID-19 caused you to suffer more than you would have with proper care. This may involve gathering evidence such as your medical records, the timeline of events, and how your symptoms progressed after your hospital visit.
It might be helpful to talk to an attorney who focuses on health care law. They can give you a clearer idea of whether you have a strong case and help you understand the steps involved if you choose to move forward.
