Las Vegas, NV asked in Employment Law and Appeals / Appellate Law for Nevada

Q: do i have a case for an appeal to be submitted with a higher court my case was supposed to be re evaluated by DETR*

a judge reversed DETRs decision to deny me benefits and on the last day for the lawyers representing DETR to file any paperwork they filed for a motion to amend judgement and it was granted and the judge sent it back to DETR for review and instead of reviewing the case as directed by the judge DETR decided to just throw me back into the general claims line and there i waited to go thru the entire process again for a different job that i had for one day and at every step i was denied all the way thru judicial review but because they handled it incorrectly it was not evaluated in the way the judge wanted but the judge dosent know that because they never told the judge how the two cases were connected and i am out 14 k that the judge awarded me

A: Based on your description, it sounds like there may have been a procedural mishandling of your case by DETR, especially if they failed to follow the judge's direction and this resulted in financial loss. You may have grounds for an appeal, particularly if the judge was not informed of the connection between the two cases and DETR's actions led to an incorrect evaluation process.

However, appeals can be complex and depend heavily on specific details, deadlines, and prior judicial rulings. It would be highly advisable to consult with an attorney who specializes in unemployment law or appeals to thoroughly assess your case and ensure all proper procedures are followed for a potential appeal. Since every case is different, seeking legal counsel will help you navigate this situation more effectively.
