Q: I would like to know if I can hire an attorney to verify if my son's dad has received a settlement check?

Hello my son's father is trying to avoid paying child support and he has received a settlement check but I believe that he put the check in his wife's name or another family members name. I would like to know if I can pay an attorney to find information on the settlement and verify that it was issued to him.

A: Yes,. You can do that and more. If the father owes money you can file a contempt/collection case and if you know the source of the settlement and/or the attorney who procured it for him you can issue a subpoena directly to them. If you don't know you can issue written questions to the father asking that he disclose all money received including form the settlement and other information that can help you determine the source, the amount and location of the money and then subpoena those entities to get the amounts and totals. On top of all of this if you prove he had the ability to pay but didn't and even more so attempted to hide the money he can be held in contempt and could be jailed, made to be costs and attorney fees or suffer other sanctions deemed appropriate by the court.
