Q: What to do if you are a shareholder and the president of the comp. Is using business funds forpersonal&u r no longerpaid

I am 38% owner of a construction corp left by by father by brothers hold 38% & 23%. The brother owning equal shares as me has pushed me out of the company and has stopped my paychecks and yet owes me loan payments from the business. I have reason to believe he is stealing from the company. The assets the company owns are destroyed , trucks are dented and not up-kept. When I left the company everything was in order. He has taken out loan after loan and has adjusted his pay as well as his girlfriends who he has working for the company she is being compensated ~ $1300 a week for doing payroll, but he will not allow me into the business to earn a pay check and I am equal % shareholder as him. He has not been upholding his fiduciary responsibility, we have been waiting on financials for over 2 years. How do I get him to show me the financials to determine if I need to press charges or if there is going to be any hope in me being paid back from what I loaned the company?
