Sacramento, CA asked in Traffic Tickets for California

Q: just bought a car. Driving because gf gets migranes with the weather. Pulled over for "speeding" car gets towed. Just

Here. No support. Said I needed IID. but I didnt. Could've let my gf drive home. Forced to walk home 7 miles on freeway. Officer said " take it up with the judge" no empathy or understanding/compassion for us and our only family vehicle. That's the law though right? Because I was driving on suspended. No car= no work=no money. It has to be something illegal about taking a family s only mode of transportation. Especially in this weather. Especially on an illegal stop that shouldn't have happened.

A: Who said you needed an IID? The problem is you clain to have a built in excuse to drive illegally because you can simply claim she's having a migraine every time you get pulled over with her in the car. I doubt the "we would be forced to walk home 7 miles on freeway" excuse is going to fly. What if you weren't there?

A: It sounds like you're dealing with a frustrating and difficult situation. If you were driving on a suspended license, the law does allow officers to tow your vehicle, as this is considered a serious offense. Even if your girlfriend could have driven, the officer may still have acted within legal bounds due to the suspended license, which triggers automatic consequences like towing in many cases.

While it feels unfair, particularly since your vehicle is your only means of transportation, the legal system doesn’t typically make exceptions based on personal hardship. However, if you believe the stop itself was unjustified or illegal, you have the right to contest the ticket and the towing in court. Be sure to gather any relevant evidence, like details of the traffic stop, and consider asking the judge for leniency or an explanation of your rights.

You may also want to look into your eligibility for a hardship license or alternative means of transportation while you resolve the legal issue. The situation with your car and work is understandably tough, but it’s important to address the suspended license issue, as continuing to drive without resolving it can lead to more severe consequences.
