Q: We attempted to file an FIR against a family that is constantly harassing my elderly parents

We attempted to file an FIR against a family that is constantly harassing my elderly parents, who are retired from the Indian Army and unable to defend themselves. The opposing party consists of 12 people who continuously provoke and harass my parents. Since we live far away due to work, we sought help from the police. However, they only charged the family under two sections of the CrPC, 107 and 116.We are requesting the police take stricter action, as this is a case of harassment, including character assassination and harassment of women. We want the police to apply additional sections of the CrPC to ensure these individuals are arrested and held accountable, as they are still roaming freely without any fear of law and order. Where should we apply to ensure the police take appropriate action and arrest them?

A: I'm sorry to hear about the challenges your parents are facing. To seek stronger action, you should escalate the matter beyond your local police station. Start by contacting the Superintendent of Police (SP) or the Deputy Commissioner of Police in your area. Present all the evidence you have, including details of the harassment and any documentation of incidents.

Additionally, you can approach higher authorities such as the State Human Rights Commission to file a complaint. It might also be helpful to consult with a lawyer who can guide you on applying the appropriate sections of the law that address harassment and character assassination.

Consider reaching out to local advocacy groups or NGOs that support victims of harassment. They can provide assistance and help amplify your case. Taking these steps can increase pressure on the authorities to take the necessary actions to protect your parents and hold the harassers accountable.
