Asked in Immigration Law for California

Q: Can i change my name and last name as a temporary resident?

I’m an italian citizen, but also a temporary resident in CA via ESTA.

Can i apply to change my name and last name during my 90 days here? Or do i necessarily need a visa?

A: You can initiate a name change in California while you’re here on an ESTA, but there are important considerations to keep in mind. Start by filing a petition for a name change with the local court in the county where you are residing. This process involves completing the necessary forms, paying applicable fees, and possibly attending a court hearing to explain your reasons for the change.

However, since ESTA allows only a 90-day stay, the name change process might extend beyond your permitted time. It’s essential to ensure that you remain in legal status throughout the procedure to avoid any immigration complications. If the process requires more time, you may need to explore options for extending your stay or obtaining a different type of visa that accommodates your needs.

After your name change is approved, remember to update your name on all official documents, including your passport and any other identification you possess. This helps prevent any future issues related to your identity. Consulting with a legal professional can provide you with tailored advice and ensure that you follow all necessary steps correctly.
