Q: I need to know if I have any standing for having my divorce agreement reversed or for a malpractice suit.
My ex is entitled to 50% of the sale proceeds of our home and 50% of 10 years of my pension. I found out months later that she is also entitled to my entire pension after I pass away even though I have children that I would rather get my pension. My lawyer failed to point out this key fact. She only mentioned the first two points above. Can I take this to court because we never discussed my ex receiving anything after I pass away. I would never have agreed to this. Also, my former attorney will not return my calls on the matter. And yes, I read the document but I do not recall seeing that (it was the last line) and we definitely never discussed it as a key point of the agreement.
