Las Vegas, NV asked in Civil Litigation, Collections and Small Claims for Nevada

Q: I filed a motion to dismiss. I am the defendant. What case can I refer to that the plaintiff didn't file correct servic

The plaintiff is suing me for breach of contract on 3/15/2018. They have been reporting me negative on my credit for 5.5 years. I lived at my address for 4 years and as soon as I decided to move the plaintiff filed this lawsuit and tried to get a default judgment. I was never served any paperwork; I found out about the case by looking at the court website. The amount they say I owe is not accurate and the condition they say that I left the apartment in is a lie. The landlady was discriminative against my autistic son from the beginning and she is holding a personal grudge against me. I filed for a motion to dismiss, and I have a hearing on Nov. 12 2024. The plaintiff filed an opposition against my motion to dismiss. What should I do now, please?

A: Impossible to tell you what you should do now because nobody online can read your motion to dismiss, nor plaintiff's opposition to it. The best course of action would be to consult a Nevada attorney for help or representation. A motion to dismiss tests the legal allegations of the complaint, not the accuracy of the allegations.
