Q: Can I file a temporary restraining order with a custody arrangement against my husband for emotional distress/harassment
We have a 2 year old and own a home together and 1 car (although it is in his name against my wishes). I paid for the entire car and 100k-1/3 of the house so concerned about starting the divorce process out of being screwed out of both. There have been two instances of assault and one instance of sexual assault this year-- all of which were not reported and ultimately brushed off/explained away to this day. Primarily, he just will not permit space or a reasonable custody arrangement while we can see a couple's therapist. He enters my home regularly and calls/texts me probing me, it triggers severe panic attacks then he leaves, threatening divorce or to take my kid away from me. I- and several therapists in a row- believe I have developed panic attack disorder and MDD simply as a result of his toxic presence. My mental health is declining so rapidly that I was in the ER this weekend due to malnourishment and losing consciousness during a bad panic attack triggered by his last visit.
