Gilbert, AZ asked in Contracts, Personal Injury, Car Accidents and Civil Litigation for New Mexico

Q: What can I do if a judge is unwilling to hear my case after a default judgement because I was never properly served?

I was sued (civil) and later found out that my 15 year old with a traumatic brain injury was served. My child has no knowledge of this service and I never received any paperwork. I asked the court to reconsider, to hear my case and informed them of the improper service, had medical records to support my claim and the judge wouldn't even consider. Now I'm stuck with this default judgement that is ruining my life! My proceeds from an auto accident are being garnished and I'm about to lose my home. I cannot afford an attorney and this whole thing is so unfair and wrong! Does anyone have any suggestions that may help?
