The Bronx, NY asked in Divorce, Domestic Violence and Identity Theft for New York

Q: I believe I may have been a victim of Human Traffic committed by my ex. How to address this on my divorce case?

We met in Brazil in 2007, and reconnected in 2011. He filled bankruptcy in NYC, went to Brazil to attest he loved me and convinced me to move to NYC later that year. Less than 6 months later, he proposed, but because of Defense of Marital Act, we only got married in 2013. My ex issued the first credit card on my name a month before we got married. 10 credit cards were issued on my name moving $300k between 2015 and 2019. I was aware of the existence of some accounts but never been aware of the amounts he used or even the changes overtime. he made me believe that I was inferior to work repairing a beach house, also who take care and maintain everything house, which was rented adding $30k income per season. The divorce was filled after the bankruptcy was removed from his report and my new job conflicted with continue working over the property. Over the years he used economic and psychological abuse to keep me under control and after 6 years delaying the case the abuse continues.

1 Lawyer Answer

A: First and foremost the asker must retain a lawyer to represent her and guide her throughout her divorce. We cannot provide such a service here online. Secondly, the asker makes rather bombastic allegations that should appear in the pleadings prepared by her lawyer. Some facts are important while others must be filtered out. Then, one must understand that the judge assigned to the divorce action may want the parties to settle their case rather than go to trial. The average New York judge lacks the skill to conduct a trial, and the costs of trial are not worth the risks.
