Santa Barbara, CA asked in Child Support and Family Law for California

Q: Can I reduce my child support payment temporarily? and how?

I have accumulated more debt, I have been homeless and am in danger of getting my car repossessed. I don't want to stop child support payments but I am in a really tough financial crisis. The mother of my children has threatened me several times and has even asked me to go over my financial obligation each month. I want to get back on my feet but its hard without any legal advisement

A: Yes, you can request a temporary modification of child support payments in California if you're experiencing significant financial hardship. Your situation - including homelessness, risk of car repossession, and mounting debt - would likely qualify as a substantial change in circumstances.

To modify your payments, you'll need to file Form FL-300 (Request for Order) with the court where your original child support order was issued. Include detailed documentation of your current financial situation, including income statements, expenses, and evidence of hardship. You should also fill out Form FL-150 (Income and Expense Declaration) to provide the court with updated financial information.

While working through this process, keep making whatever payments you can to show good faith, and document all communications with your children's mother. Consider reaching out to your local family law facilitator's office at the courthouse - they provide free help with forms and procedures. You might also qualify for free legal aid through organizations like Legal Aid Foundation of Santa Barbara County. Remember, the court understands that circumstances change, and there are legitimate ways to adjust support payments while still meeting your parental responsibilities.
