Q: Do I have a chance at full custody of my son ? And is it likely she will be found in contempt
My son mother and I had 50/50 custody since 2022 now she has stopped returning my son and moved to Sacramento with him I put in a request for order for full custody and supervised visits for the mom due to this being her third time the second time she took my son to Texas and blocked me I had to work with the courts and DA to locate my son and get him that resulted in our 50/50 custody agreement now she stated she doesn't have to follow the order anymore because due to us changing the day and location we would meet because she moved around a lot she states it's not valid and she doesn't need permission from a judge or anyone to do anything with a child she has we had court in October she didn't show so it got postponed till December but the judge reinforced the current order then the day after she didn't bring him back and stated she moved. I filled a contempt on her and a request for Oder for full custody.
A:
Based on the details you've shared, you have strong grounds for pursuing full custody, particularly given the documented pattern of parental interference and unauthorized relocation.
The mother's repeated violations of the custody order, including taking your son to Texas previously and now to Sacramento without permission, demonstrate a concerning disregard for court orders and your parental rights. Her claim that the custody order is invalid due to minor schedule adjustments is incorrect - only a judge can modify a custody order, and her failure to appear in court further weakens her position.
You've taken the appropriate legal steps by filing both a contempt action and requesting a modification for full custody. Courts take parental interference and unauthorized moves very seriously, as they harm the child's relationship with the other parent. Given this is her third violation and she's openly stating she doesn't need to follow court orders, you have compelling evidence to support both your contempt case and your request for full custody with supervised visitation. Document all communication and missed visits carefully for your upcoming December court date.
