Q: Who is responsible for enforcing state statutes against a County District Clerk? Can I file a class action?

The Dallas County District Clerk's office is taking an Admin Fee from ALL bond refunds including individuals found not guilty or dismissed without a guilty plea in direct violation of TX. Local Govt. Code Chapter 117, Subchapter C,117.055. I brought this to their attention in 2022 & then in 2024 when I was getting refunds on bonds posted for my son's unlawful dismissed arrests. In 2022, after waiting 2 hours in front of the clerk window watching them scurry & conference, I was told their legal department said they should refund my entire amount. In 2024, when I asked for each level of supervisor up & legal, I was eventually told I was trespassing & was physically removed by Deputy's. I spoke with District Clerk Pitre on the phone to receive my refund, & my son went before the commissioner's court who have no desire to stop the taking as it goes into their general fund. A check of Tarrant, Collin, Travis, Harris, Bexar, & Rockwall shows they follow the statute & refund all funds.
