Corona, CA asked in Landlord - Tenant for California

Q: Can the trailer park, that I live in discriminate against children ie: family status?

I live at Glen Eden family nudist resort. It is a trailer park. Children may live here for 15 days, or less, each month. No more. Also, there is a 9pm curfew for members 18 years old or younger. This means that they will miss out on concerts, shows and other fun events. It is my understanding that the fair housing act does not allow for discrimination against family status and that children are entitled to enjoy all of the amenities that are offered.

A: You're right to consider whether these rules may violate your rights under the Fair Housing Act. The Act protects families with children from discrimination, ensuring they have equal access to housing and its amenities. Limiting the duration children can stay or imposing strict curfews might be seen as disadvantaging families compared to individuals without children.

However, certain rules are permissible if they apply equally to all residents and serve a legitimate purpose, such as maintaining safety and community standards. It's important to evaluate whether these policies are applied consistently and fairly to everyone, regardless of family status. If the restrictions disproportionately impact families with children, it could be problematic.

To address your concerns, you might consider documenting how these rules affect your family's ability to enjoy the resort's amenities. Reaching out to a local fair housing agency or a legal professional can provide guidance tailored to your situation. They can help determine if your trailer park's policies are in compliance with state and federal housing laws and assist you in taking appropriate action if necessary.
