Q: What does Illinois law say regarding the retrieval of personal property from a vehicle after it has been repossessed?
My mother’s vehicle has been in my possession for a few months after she passed away. After passing, I called the lienholder and informed them of what happened and asked what the next steps were. They informed me that they could not provide any information until someone (me) was legally named executor of my mother’s estate. It took some time, but I finally got it done last week and was legally named executor. A few days after being named executor, the car was repossessed via tow. I setup an appointment to retrieve my personal property from the vehicle and thet owing company said that there would be a fee for me to retrieve my things. Can they lawfully do this? How is this acceptable?
