Q: I am being sued for a workman's liability issue in Cleveland Co. Oklahoma. Can I counter sue for attorney's fees?
My liability insurance lapsed for non-payment the month this allegedly happened; automatic electronic funds didn't process correctly. This means we do not have representation through an insurance company and attorneys ' fees will be out of pocket. The quote was over $100,000 to defend us which we do not have. The attorneys who did the preliminary work said this was a frivolous lawsuit with no merit and barely any evidence. I can give you more details about the lawsuit if you need them. Will I be able to counter-sue before the settlement of the civil case?
