Q: Our HOA has 370 units and our CC & R prohibits more than a 10% increase per year on HOA fees.
We had a special assessment for a community sinkhole at our pool and we all paid equally for the repair. After the sinkhole was repaired and paid off via a loan from a bank, the HOA continued to charge us an assessment , equal to what we were paying for the special assessment . They no longer called it a special assessment but an assessment. It was lumped together with our normal HOA fee, not separated and the management company has refused to separate the two so we could actually see what we are paying for beyond our 10% increase per year. We do need new roads but the bank refused to give us a loan because 96 of the 370 units were behind on their HOA fees and delinquent. They said the loan would be for 500K because they collected 100K from us already. We had no idea that they collected money for the road project at all. We were told the extra money was because we were behind in reserves, insurance went up..etc etc. How do we make them give us a detailed report of our HOA fees?
