Q: Can an adult hire an attorney for someone else's minor child without the parent's consent?
Our minor(17) son is currently living with a different guardian. We found out that he took responsibility for a single car crash where one of his friends left the scene(presumably alcohol related). The friend's father hired an attorney for our son. Aside from the fact that I believe this means our son has perjured himself, filed a false report, etc., we can't understand how the people who should be looking after his interests could allow this to happen.
A: No one asks who hired the lawyer. Either the person has one or, if jail is a possibility, one is appointed. If you want to object I suppose you can go to court and do so, but I would think you should talk to your kid's lawyer first.
A:
No perjury because he has not testified under oath. As far as why the guardian is not doing a better job, that’s not really a legal question. Kids do some silly things, both your son and the other kid.
Not knowing all the details, I would be a little bit concerned that the lawyer who the father of the apparent wrongdoer hired might have a conflict because to help your son it’s possible he would have to throw under the bus the son of the man who is paying him.
