A: Hi - I practice extensively in this area. Mesothelioma. Is the family member an heir? Is their an attorney involved? A family member can file a claim on behalf of the injured party. Since mesothelioma is such a devastating disease, often times it is the family members (the successors or Personal Representatives) handling lawsuit/claims during the end of someone's life. For these Mesothelioma claims (I assume you are talking about Claims with Asbestos Trusts), some Trust funds provide additional recovery for a victim if the claim is filed when someone is living. If it is a remote family member, who is not an heir, that is a problem.
