Q: Based on a consumer's "Right to Cancel" in NJ would the following be legal or illegal?
My father signed a contract with the following statement included: "There is a 72 hours (3 days) right to cancel, if the customer/s is not satisfied with the job being agreed upon or job being started, therefore ___ LLC and the customer would agree on a compensatable (monetary) number and part ways". Is this legal? I thought the purpose of the 3-day right to cancel is to give consumers a chance to reconsider their decision without any financial penalty.
I have a bad feeling about this because the work started the same day that the contract was signed. The other party did not wait 3 days. Also, the other party requested cash payments instead of checks. When I told the individual that my father would prefer to pay with checks, the person refused. Furthermore, he called me at night insisting that I Zelle him the money, the same day that the contract was signed, to avoid waiting days for the checks to clear. This seems like a red flag since I'm not involved in the deal. Is this legal?
