Pinellas Park, FL asked in Consumer Law and Collections for Florida

Q: Is it worth pursuing credit card company for compensation for their illegal practices?

I have a credit card account with this company. Twice in the last year I've been late on payment. When I say late, I mean less than two weeks; not long enough for it to even be reported to the credit bureaus. Within a week of missing payment, this company calls 7-10 times a day from MANY different numbers. Some numbers are caller ID verified as that company and some numbers are unverified. The unverified numbers have the same area code as my phone despite the fact that I don't live anywhere near that area. When looking up these numbers online, many others publicly confirm these calls are from this credit card company.

So calling numerous times a day and using fake numbers...is it worth legal action?

A: A Florida attorney could advise best, but your question remains open for a month. This is not my area of practice, but based on the brief description, it does not appear to be something that attorneys would handle on a contingency basis. Missing payments, however minor in lateness, does not work in your favor. Other attorneys could see things differently - the most reliable way to answer your question would be to discuss with attorneys who are knowledgeable in acceptable collections practices under Florida law and collection defense litigation. Good luck
