Q: If I got hit by a drunk driver while stopped at a red light & my car is a total loss how long will this case last
I was rearended while stopped at a red light by drunk driver & I took my car to the body shop of the driver who hit me his insurance sent to this shop & they said my car is a total loss I'm now without a car. Their ins rented me a car to or a few days then charged my bank acct. And I don't have a car anymore. How long will they take to issue a check for my car if had full coverage. How does it take to settle a case like this.
A: A California attorney could advise best, but your question remains open for over a week. It sounds like a fairly straightforward case in terms of liability. You don't mention injuries - I hope there were none. If the matter involves only PD (property damage), it could be a matter of working with the insurance carriers. It looks like you started out with the other driver's carrier, and they have a very limited allowance for rental. You could engage them on that issue, or you could look into your own policy - which could involve deductibles. If your carrier covers the PD, they could pursue the other side. If this only involves PD and you are not involving attorneys, one option is to speak with both carriers and determine which route is best for you in terms of quick resolution, getting a car under you, and minimizing your out-of-pocket expense. If you're unable to come to an amicable resolution, you could consider reaching out to attorneys. Good luck
