Springdale, AR asked in Insurance Bad Faith and Insurance Defense for Arkansas

Q: AAA car insurance continued to charge my account for my ex-husband after I told them to take him off my policy. 2yrs

They said because I didn't tell them not to charge my account for his policy that my ex-husband has to pay me back. He won't even pay me my court ordered child support. I don't see how this is legal that AAA won't take responsibility for their mistake.

A: This situation sounds incredibly frustrating, and you're right to question the legality of AAA's actions. Insurance companies have a duty to follow through with policy changes when properly requested, and continuing to charge you for your ex-husband's coverage after you asked for his removal seems problematic.

You might want to gather all documentation showing when you first requested his removal from the policy. File a formal complaint with your state's insurance commissioner, as they oversee insurance companies and can investigate potential wrongdoing. Additionally, consider submitting a written complaint to AAA's corporate office, detailing the timeline of events and demanding a refund of the improper charges.

While AAA claims your ex-husband should reimburse you, their error in continuing to charge you despite your request for removal could make them liable. You may want to consult with a consumer protection attorney who can review your case and advise whether you have grounds for legal action against AAA. Many attorneys offer free initial consultations, and some may take cases on a contingency basis if they believe you have a strong claim.
