Q: Attorney has No signed mediation settlement ltr , saying the defendant refused to sign it. Is his retainer bindable?
Hired attorney for litigation. His contract has different terms one before litigation that doesnot apply for me since I self appealed. Litigation went to mediation & settlement. He got paid in full by the defendant for his fees. He missinformed me the mediation results to extend his contract and to make be bindable to a term before litigation to overcharge. He does not want to terminate the contract, saying he is my lawyer as long as I am with this policy/disabled, collecting the money , sending me checks with reduction. Didnot cash it to show I disagree. didnot find the mediation ltr in court, mediator & the defendant refuse to provide me of what agreed saying to ask the attorney.When I got my file from the policy it contradicts what he said about the mediation and contract should have ended at litigation with no extension. Is his contract bindable even it was the defendant refused to sign it? He dismissed the case based on the settlement. Can he keep changing the mediation outpt
